Guide to the ATV Laws of New York

If you live in the New York area and own an ATV, it’s important that you know the relevant laws and regulations. Following these laws will not only help you avoid legal consequences, but it will also help keep you safer. Registration

Any ATV ridden within the state of New York must be registered with the Department of Motor Vehicles (DMV), even if your intention is to only ride it within the confines of your property. Dealers will usually register your ATV for you if you buy from them, though if you purchase from a private seller you’ll need to complete the registration yourself. Both registration and renewal cost $12.50, with an additional license plate fee of $12.50 paid the first time the vehicle is registered. You’ll also need to provide proof of ownership, sales tax payment, identity, and date of birth. This registration will last one calendar year before it needs to be renewed.

Insurance

If you plan to ride your ATV somewhere other than your own property, you’ll need liability insurance. When it comes to ATVs in the state of New York, the legal minimum coverage is $50,000/$100,000 for death, $25,000/$50,000 for injury, and $10,000 for property damages per occurrence. Bear in mind that you might need to provide proof of insurance. 

Licensing and Age Restrictions

While you do not need a license or permit to operate an ATV in the state of New York, operators under the age of 10 can only ride on land owned by their parents/guardians or with adult supervision. Those between 10 and 15 years of age are under similar restrictions, though they can also ride if they are in an area where ATV use is allowed and they have completed a DMV-approved ATV safety course. Riders 16 and up have no restrictions. 

Requirements

New York law requires that anyone operating an ATV wear a US DOT-approved helmet. It’s also important that the brakes and muffler be in good working order, and that the vehicle is equipped with a spark arrestor approved by the U.S. Forest Service. In addition, the tires need at least 2/32 inch tread and the ATV must have a white headlight and red tail light that are kept illuminated from a half hour after sunset to a half hour before sunrise.
